Steps in a DUI Case
Scheduling a Preliminary Hearing
An arrest for driving under the influence carries with it a long, comprehensive and often complicated legal procedure. The first step is scheduling a Preliminary Hearing at the district court in your area. This step will present the presiding judge with evidence in order to decide if it is substantial enough to proceed with your case. In most cases with minimal exceptions the judge will order a pending hearing for future months. Following this is the arraignment portion of the case. This step is intended to inform you the charges that are being brought against you and to ensure that you have a clear understanding of them. A trial then follows. Here, witnesses and experts are called upon to present their testimony and opinions. The trial will commence with a jury decision identifying your innocence or guilt in the matter.
